The law in Israel permits the establishment of a sukkah in a shared yard, as long as it is a reasonable use that does not infringe on the rights of other neighbors. If the neighbor opposes the establishment of the sukkah, he cannot prevent it, provided that its use does not block passages or create a nuisance. In case of blocked access or unreasonable noise from the sukkah, it is advisable to document the situation and approach the neighbor with a request to move the sukkah. If he refuses, one can contact the land registry supervisor or local authorities. Additionally, the neighbor is not allowed to use the shared electricity without permission, and the tree in the shared garden cannot be used for personal purposes without consent. At the end of the holiday, if the sukkah remains in the shared yard, one can demand its dismantling, as leaving it beyond the permitted time is considered illegal possession.
